ThemeVix Terms of Service

Effective date: March 7, 2026

1. Introduction

These Terms of Service (“Terms”) govern your use of the ThemeVix website and all products, services, and digital materials offered by ThemeVix (“we,” “us,” or “our”), including but not limited to:

  • WordPress plugins (for example ThemeVix AI Chat, ThemeVix Direct Chat Button, and future releases)
  • WordPress themes
  • Documentation, downloads, support, and related website content

By accessing themevix.com or using our products, you agree to these Terms. If you do not agree, do not use our website or software.

2. Who these Terms apply to

These Terms apply to:

  • Visitors to our website
  • Customers who purchase or download our products
  • WordPress site owners who install ThemeVix plugins or themes
  • Contributors, reviewers, and support forum users

If you install a ThemeVix plugin on your own website, you are also responsible for your site visitors’ rights under applicable privacy and consumer laws.

3. Eligibility

You must be at least 13 years old to use our website. If you are under 18, you may use our website only with permission from a parent or legal guardian.

By using our website or products, you confirm that you meet this requirement and have authority to agree to these Terms on behalf of yourself or your organization.

4. Our products

ThemeVix develops WordPress plugins and themes designed for performance, security, and compatibility with current WordPress standards.

Products may be distributed:

  • Through WordPress.org (free, open-source, GPL-licensed)
  • Through ThemeVix.com or other authorized channels (free or paid, as stated on each product page)

Each product may have its own documentation, requirements, and feature set. Product pages and readmes describe what each plugin or theme does. You are responsible for reading the documentation before installation.

5. Open-source license (WordPress.org products)

WordPress plugins and themes distributed on WordPress.org are free software licensed under the GNU General Public License v2.0 or later (GPL-2.0-or-later), unless otherwise stated on the product page.

Under GPL, you may:

  • Use, copy, modify, and redistribute the software
  • Receive source code (including human-readable source for any bundled minified JavaScript, where provided in the package)

ThemeVix retains copyright in original works but grants rights under GPL for GPL-licensed products. Third-party libraries included in our products are used under their respective licenses as documented in each product’s readme or license file.

Nothing in these Terms restricts your GPL rights for GPL-licensed products.

6. Paid products and commercial licenses

If a ThemeVix product is sold or licensed separately from WordPress.org (for example premium themes or paid extensions), the license terms shown at checkout or on the product page apply in addition to these Terms.

Unless stated otherwise:

  • One license typically applies to the number of sites specified at purchase
  • You may not resell, sublicense, or redistribute paid products except as allowed by the product license
  • Refund terms, if any, are stated on the product or checkout page

7. Plugin-specific terms (all ThemeVix plugins)

The following applies to every ThemeVix WordPress plugin, including current and future releases.

7.1 Self-hosted software

ThemeVix plugins run on your WordPress installation. Unless a specific product page states otherwise:

  • ThemeVix does not host your website data
  • ThemeVix does not operate a remote licensing phone-home or usage telemetry service for standard WordPress.org plugin distributions
  • Plugin data is stored on your server according to each plugin’s function

7.2 Site owner responsibilities

If you install any ThemeVix plugin, you are responsible for:

  • Complying with applicable laws (privacy, ecommerce, marketing, accessibility, and consumer protection)
  • Publishing and maintaining an accurate privacy policy and cookie notice on your site
  • Obtaining consent where required before collecting personal data
  • Securing your WordPress admin, hosting, API keys, and webhook secrets
  • Testing updates on a staging site before production use
  • How you use plugin features with your customers or visitors

ThemeVix provides software tools only. We do not provide legal, tax, or compliance advice.

7.3 Third-party services

Some ThemeVix plugins may connect to third-party services only when you enable and configure them, such as:

  • Messaging platforms (WhatsApp, Messenger, Instagram, Telegram, etc.)
  • AI providers (OpenAI, Anthropic, Google, Groq, DeepSeek, etc.)
  • CRM, email, analytics, fonts, webhooks, or payment services

ThemeVix does not operate these third-party services. Your use is governed by their terms and privacy policies. You are responsible for configuring integrations lawfully and disclosing them to your users.

Details for each plugin are in that plugin’s readme.txt, product page, and/or Privacy Policy section.

7.4 Bring your own credentials (where applicable)

Some plugins (for example ThemeVix AI Chat) require you to supply your own API keys or account credentials. ThemeVix:

  • Does not include paid third-party API access
  • Does not bill you for AI or external provider usage
  • Is not responsible for third-party pricing, limits, outages, or content policies

8. ThemeVix AI Chat (supplemental terms)

If you use ThemeVix AI Chat, the following also applies:

  • WooCommerce is required
  • You must provide your own AI provider API key (BYOK)
  • Chat and store data remain on your WordPress site unless you configure external integrations
  • AI-generated responses may be inaccurate; you must not rely on AI alone for critical legal, medical, financial, or order decisions
  • Guest order lookup features, if enabled, must be disclosed in your store privacy policy
  • Google Fonts and other optional integrations are disabled by default unless you enable them

9. ThemeVix Direct Chat Button (supplemental terms)

If you use ThemeVix Direct Chat Button or similar messaging plugins:

  • The plugin facilitates links or buttons to third-party chat apps (for example WhatsApp)
  • ThemeVix does not control conversations that happen on those third-party platforms
  • You are responsible for disclosing how visitors contact you and how their data is handled on those platforms

10. Acceptable use

You agree not to use our website, plugins, or themes to:

  • Violate any applicable law or regulation
  • Infringe intellectual property, privacy, or other rights of others
  • Distribute malware, spam, or abusive content
  • Attempt to bypass security, authentication, or rate limits
  • Misrepresent AI-generated or automated content as human where prohibited by law
  • Use our software for unlawful products, services, or activities

We may refuse support, revoke access to paid services, or report unlawful activity where appropriate.

11. Intellectual property (ThemeVix website and branding)

All ThemeVix website content, branding, logos, marketing materials, and non-GPL proprietary assets are owned by ThemeVix or its licensors and protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our website content or branding except:

  • As allowed by GPL for GPL-licensed plugin/theme code
  • With our prior written permission
  • As permitted by applicable law

12. User content (reviews, comments, support)

If you submit comments, reviews, forum posts, testimonials, or other content to ThemeVix, you grant ThemeVix a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, promoting, and improving our products and website.

You represent that your content:

  • Is accurate to the best of your knowledge
  • Does not violate any third-party rights
  • Does not contain unlawful, abusive, or misleading material

We may remove content that violates these Terms or applicable law.

13. Support

Support availability depends on the product:

  • WordPress.org plugins: Support may be provided through the WordPress.org plugin support forum and/or email
  • Premium products: Support terms are described on the product or checkout page

Support is provided on a reasonable-efforts basis. We do not guarantee response times, custom development, or compatibility with every third-party plugin or hosting environment.

14. Updates and compatibility

We may release updates to fix bugs, improve security, add features, or maintain compatibility with WordPress, WooCommerce, PHP, or third-party APIs.

You are responsible for:

  • Keeping WordPress, PHP, and dependencies reasonably up to date
  • Backing up your site before updates
  • Verifying compatibility on a staging environment when possible

We are not liable for issues caused by outdated hosting, PHP versions, conflicting plugins, or modified code.

15. Disclaimer of warranties

Our website, plugins, themes, documentation, and support are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy of AI-generated or automated outputs

Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent permitted by law.

16. Limitation of liability

To the fullest extent permitted by law, ThemeVix and its owners, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity arising from:

  • Use or inability to use our website or products
  • Third-party services you configure
  • Data loss on your WordPress site
  • AI or messaging provider errors or policy changes
  • Unauthorized access caused by your environment or credentials

Our total liability for any claim relating to a specific product shall not exceed the amount you paid ThemeVix for that product in the 12 months before the claim.

For free WordPress.org plugins, total liability is limited to zero ($0), except where prohibited by law.

17. Indemnification

You agree to indemnify and hold harmless ThemeVix from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of our products on your website
  • Your violation of these Terms
  • Your violation of applicable law
  • Content or data you collect from your site visitors
  • Your configuration of third-party integrations
